Mild Brain Injury/Concussion

A concussion is the mildest degree of a traumatic brain injury. It can be caused by a direct blow to the head or a penetrating injury. Both open and closed wounds can lead to this type of trauma. While a skull fracture, lacerations, and bleeding may be associated with the injury, these are not necessary to suffer a brain injury.

A mild traumatic brain injury is defined as losing consciousness for no more than 20 minutes and a rating of between 13 and 15 on the Glasgow Coma Scale, which is based on eye-opening response, verbal response, and motor response. The higher the rating, the better. The lower the rating, the more severe the brain injury.

Common signs of a concussion are headaches, memory loss, confusion, dizziness, ringing in the ears, nausea, slurred speech, delayed responses, and fatigue. It is possible for you to experience a number of these symptoms for days, weeks, or months following the accident.

You can also experience concentration issues, light and sound sensitivity, sleep, and depression. These symptoms can make it difficult to return to school or work right away and may require additional medical care.

Moderate Brain Injuries

A moderate TBI is defined as losing consciousness from between 20 minutes to six hours and has a rating of between nine and 12 on the Glasgow Coma Scale.

Moderate TBIs can result in myriad physical, mental, and emotional consequences. A moderate TBI usually results in cognitive difficulties, including attention and concentration issues, memory difficulties, impulsiveness, and reduced executive functioning.

There may be speech and language symptoms, including problems understanding spoken and written words, writing, and slurred speech. You might suffer from sensory difficulties like sensitivity or lost or diminished hearing, taste, or smell. You may have physical pain, appetite changes, and suffer a sleep disorder. Social-emotional difficulties are common, including irritability and depression. You could also experience seizures following a TBI.

You can expect the symptoms of a moderate TBI to last weeks or months, and it is possible to have permanent changes from this injury.

Severe Traumatic Brain Injuries

A severe TBI is defined as a brain injury causing unconsciousness for more than six hours and has a rating on the Glasgow Coma Scale of three to eight. This significant injury results in permanent brain damage, though the consequences depend on a variety of factors, including the injury, how quickly you sought treatment, and the therapies available to you.

With a severe TBI, you can experience all the same symptoms as a person with a moderate brain injury, though often to a greater extent. You are much more likely to live with a disability permanently or for a significant period after the accident.

Common Causes of Brain Injuries

Anything that results in a sudden blow to the head or intense shaking could cause a TBI. Some common accidents and incidents where brain injuries are frequently seen include:

  • Accidentes de tráfico
  • Accidentes de moto
  • Accidentes de camiones comerciales
  • Accidentes de peatones
  • Resbalones y caídas
  • Negligent Property Maintenance
  • Falta de seguridad
  • Negligencia médica
  • Accidentes de bicicleta
  • Accidentes laborales

How TBIs Impact Your Life

The brain is a complex organ responsible for all areas of your life. How an accident affects it can be difficult to see on scans, and it is impossible to predict how it will heal and change over time.

How you were injured, your symptoms, and the long-term consequences of the accident will be unique to you. While one person who suffers from a moderate TBI may have a lot of physical symptoms, you may have suffered more cognitive deficits. While a severe TBI may have altered another person’s personality, your injury may have left your personality the same but affected your ability to think critically and perform executive functions.

A consequence of a TBI to one person may not have been a serious issue, yet that same consequence may alter your life drastically. For instance, sensitivity to sound would be inconvenient to anyone. However, if you are a music teacher, it could make it impossible to work.

Brain Injury Compensation

Depending on the severity of your TBI and other factors involved, you may be able to recover compensation for the assorted economic and non-economic damages stemming from your injury. This could be the difference between recovering the wages you lost or will lose, getting the medical care you need, and putting your life back together.

If you or a loved one suffered a traumatic brain injury because of a negligent or careless act, you could pursue an insurance claim or personal injury lawsuit. Depending on the nature of your injuries, you may be able to recover your:

  • Gastos médicos
  • Pérdida de ingresos
  • Discapacidad
  • Desfiguración
  • Dolor y sufrimiento
  • Angustia mental
  • Pérdida de la vida en común
  • Muerte por negligencia

How a Brain Injury Lawyer Can Help

Brain injury cases are complex. The severity of the brain injury in question and the circumstances around the accident will significantly affect how your case moves forward.

For instance, if you suffered a severe TBI, your compensation should consider the long-term care and compensation you’ll need. Likewise, if you suffer a head injury because a negligent driver hit you while they were making a delivery, their employer may be liable. In addition, brain injuries are major health events and usually require significant medical insight and economic knowledge. Therefore, working with an attorney experienced in brain injuries is crucial.

A skilled lawyer can illustrate what you endured and how a TBI impacted your life, making the harm apparent to a judge or jury. Your attorney will work with your physicians and medical experts to delve into the consequences of this injury on your life, including the effects on your functioning, and ability to live independently, work, and interact with others.
