Our client sustained a back injury as a result of ‘t-bone’ type collision at an intersection. The at-fault driver was underinsured so the claim had to be submitted to the client’s auto carrier. Due to our client’s inability to perform his job duties, he incurred substantial wage loss. His doctor confirmed that our client may benefit from back surgery, but he was unwilling to go through with the procedure, and instead decided he would deal with the pain on his own. As a result of his wage loss, the insurer agreed to offer the policy limits of $100,000.
