Mass torts will typically involve:

  • Record Review – A mass tort lawyer will check records to see if you have a case. They will examine allegations of injuries, medical histories, and pre-existing conditions. A mass tort lawyer will be looking to see if your claims are consistent with a bad product.
  • Distinguish Injury Uniformity – A lawyer will begin searching for similar claims so they can qualify for a mass tort.   • Settlement – If a mass tort is settled before going to trial, the defendants will pay a certain amount of money to the plaintiffs in exchange for a dismissal. If the matter goes before a judge or jury, they can rule for the plaintiffs or the defense. If the jury sides with the plaintiffs, the defendants will need to pay damages. Each plaintiff is paid their own compensation; it is not split evenly amongst the plaintiffs of the tort.
