Serious Injuries Caused by Dog Bites

Dog attacks are often caused by owner negligence. Therefore, the owner may be liable for compensating you for the damage caused by the dog. For instance, $675 million was paid in liability claims related to dog bites and other dog-related injuries in 2018.

Even a minor dog bite can cause serious injuries, lifelong disfigurement, and substantial medical expenses. Therefore, a severe dog bite can be devastating. If a dog attacks you or a loved one, take action and recover compensation for your losses.

The Youngstown dog bite lawyers at Kisling, Nestico & Redick will review your options and help you reach the best possible outcome.

The “One Bite” Rule

Ohio follows the “one bite” rule. This law states that you may recover compensation from the owner or keeper of the dog that bit you if the dog previously bit another person or acted aggressively. However, the keeper must be aware of this previous behavior.

Under the “one bite” rule, you will need to show:

  • The dog previously exhibited aggressive behavior or attacked another person.
  • The defendant was the owner or party in control of the dog when you were injured.
  • The defendant had knowledge of the dog’s previous aggressive behavior.
  • You suffered a compensable injury.

Under the “one bite” rule, you can also seek punitive damages. This is because the dog’s owner or keeper had prior knowledge that could have prevented the attack.

Ohio Dog Bite Law

Ohio has another specific dog bite law (statute 955.28). This law states that the dog’s owner or keeper is almost always responsible for injuries caused by their dog (due to the theory of strict liability).

The only time the owner is not responsible for an injury is if the injured party was teasing, tormenting, or abusing the dog. Therefore, even if the dog has not bitten before, the owner would be responsible for an injury caused by the dog.

Common Bog Bite Injuries

Dog bites can cause severe injuries with lasting effects. If you or a loved one were hurt by a dog, you should seek medical care immediately. Once, you get treatment, consult a Youngstown dog bite lawyer.

At KNR, we will review the circumstances, identify who’s at fault, and document your injuries.

Possible dog bite injuries could include:

  • Nerve damage
  • Mental and emotional trauma
  • Broken bones
  • Scarring
  • Head injuries and neck injuries
  • Cuts and bruises
  • Rabies or other infections
  • Tissue damage

While some dog-bites are life-threatening, others may still result in expensive ongoing treatment. Sometimes, plastic surgery is needed after a dog bite.

If you sustain a dog bite, you should immediately seek medical treatment. However, also try to collect any evidence of the attack. This will help your injury claim later. Be sure to include prior interactions with the dog, pictures of your injuries, potential witnesses, etc.

Dog Bite Insurance Claims

Many homeowner’s insurance policies include dog liability coverage. Therefore, you may be able to file an insurance claim for you the losses and damages you sustained.

Please note that a dog bite lawsuit or insurance claim falls under Ohio’s two-year statute of limitations. As a result, your claim or lawsuit typically must be filed within two years of the incident to be considered.
