Our client was a passenger that was hit, at a high rate of speed, on a local highway. The defendant, who happened to be a plaintiff attorney, denied a sobriety test at the scene and her OVI was later dismissed. Liability was admitted for the accident, however, and while punitive damages were going to be bifurcated per the judge’s order, we nevertheless had the claim pending. Our client sustained neck and back injuries, including a herniated disc for which she underwent a discectomy. A primary issue in the case was her pre-existing DJD and the fact that the surgery occurred three years after the accident. The defendant IME report only attributed emergency room treatment and a few weeks of treatment thereafter as being related to the accident. A few weeks prior to trial, we mediated the case and it settled for $75,000.
