Hurt in an Airplane Accident? Call KNR

Due to the size, weight, and speed of most commercial airplanes and the number of passengers onboard, an accident on the ground or in the air can lead to mass casualties. An accident involving a personal plane may have fewer fatalities; however, that does not make the incident any less devastating to the pilot, passengers, and their loved ones.

Common Causes of Airplane Accidents

  • Pilot error
  • Inability to maintain control during flight
  • Crashing into terrain
  • Runway excursions
  • Air traffic control error
  • Dispatcher error
  • Loader and fueler errors
  • Lack of or improper maintenance
  • Equipment or system failure
  • Negligent hiring
  • Lack of training/equipment
  • Bird Strikes
  • Unsafe weather conditions
  • Sabotage

Identifying Pilot Error

Pilot error is one of the most common causes of all airplane accidents, and many authorities cite it as the reason behind approximately 50 percent of incidents. Pilot error does not necessarily arise during an average flight. Instead, pilot error tends to be an issue when conditions become less than ideal. Your lawyer will investigate the accident and preserve evidence to ensure objective experts can weigh in on what went wrong and who is responsible. Your lawyer will also take a hard look at the pilot as well as the other common causes of airplane accidents.

Aviation Accident Categories

According to the International Civil Aviation Organization (ICAO), which creates regulations for aviation safety, security, efficiency and regularity, and environmental protection, there are 7 categories that account for most aviation accidents:

  • CONTROLLED FLIGHT INTO TERRAIN (CFIT) – In-flight collision with terrain, water, or obstacle without indication of loss of control.
  • LOSS OF CONTROL IN-FLIGHT (LOC-I) – Loss of aircraft control while in flight, and not primarily due to SCF.
  • RUNWAY EXCURSION (RE) – A lateral veer-off or longitudinal overrun off the runway surface, and not primarily due to SCF or ARC.
  • FIRE (F-NI AND F-POST) – Fire or smoke inside or outside of the aircraft, in flight or on the ground, and regardless of whether the fire results from an impact (F-POST) or not (F-NI).
  • ABNORMAL RUNWAY CONTACT (ARC) – Any takeoff or landing involving abnormal runway contact, and not primarily due to SCF, leading to an accident. Hard landings and tail strikes are included in this category.
  • SYSTEM/COMPONENT FAILURE OR MALFUNCTION (SCF) – Failure or malfunction of an aircraft system or component, related to its design, the manufacturing process, or a maintenance issue, which leads to an accident. SCF includes those related to powerplant (SCF-PP) and those which are not powerplant-related (SCF-NP).
  • UNDERSHOOT/OVERSHOOT (USOS) – Touchdown off the runway surface in close proximity to the runway. It includes offside touchdowns.

The leading cause of fatal aviation accidents over the last 20 years is Loss Of Control In-Flight.

Airplane Accidents: Damages & Compensation

When you are hurt or harmed because another individual or business was negligent or reckless, you may have the right to seek financial compensation for the damages you endured. Your attorneys must prove the other party’s negligence through an insurance claim or personal injury suit, confirm liability, and document your losses, so you recover the full and fair value of your losses.

Recoverable Losses After an Airplane Accident

Upon demonstrating that party’s responsibility and liability, your lawyers will pursue a financial recovery that compensates you for losses such as:

  • Gastos médicos
  • Pérdida de ingresos
  • Dolor y sufrimiento
  • Angustia mental
  • Disfigurement and disability
  • Loss of consortium – your relationship with your spouse

If your loved one died in an aviation accident, you may have cause to pursue a wrongful death claim. And under some circumstances, punitive damages may be possible if the party responsible for your airplane accident acted with malice or gross negligence. And while there is no standard formula for predicting a wrongful death settlement or injury award, you can get an idea of what to expect by discussing the facts with a lawyer.
