Our client exited a public transit bus and was crossing the road outside of the designated crosswalk. Our client was struck at a high rate of speed and the driver of the vehicle never stopped to see if our client was ok. The responding police officer eventually located the driver at his home and issued a citation for “Hit/Skip”.

The driver’s insurance company contested liability for our client’s injuries, which included a fractured left tibial plateau (shinbone). The car accident attorneys at KNR researched the traffic docket for the driver’s hit and run citation and determined that he pled guilty to a “failure to maintain reasonable control” violation. We were able to use this guilty plea to argue that the driver would not be able to contest liability in a civil lawsuit brought by our client. As a result, we were able to settle our client’s personal injury claim with the driver’s insurance company for its maximum policy limit.
