Akron Slip and Fall Accident Attorneys
Slip and fall accidents are those situations in which slipping, stumbling, or tripping because of a dangerous premises condition leads to a fall and injury. We are all familiar with such accidents: they may happen inside or outside a structure, and are often caused by poor lighting, substandard or wet or icy floors, or, weather-related or other hidden hazards. Potholes, pavement cracks, and potholes are all likely culprits.
Negligence law covers all slip-and-fall accidents, and deals with the concept of premises liability. A “duty of care” is inherent to owning property and expects that owners see to it that their property is safe. Obviously, this includes addressing all structural defects, inside and out, that could lead to an accident. These may include : loose tiles mats, or rugs on the floor; stadning water on the floor; poor lighting on any steps or stairs; cracks and holes in all sidewalks, parking lots, or other paved surfaces. Some states also assign the property owner a duty to address any problem areas caused by weather. These hazards may include standing water/ice. Any entrant onto a property also has a duty: exercising reasonable care. Because of this, if an entrant's actions may have contributed to the accident, the entrant may share in the negligence.
Upon experiencing a slip-and-fall accident, try to determine why you fell, and whether or not it could have been anticipated or prevented. Gather names and addresses of all witnesses. Note conditions in the area: the lighting, any substance(s) that may have made you slip. If you slipped due to something on the floor, obtain a sample. Also, take pictures of the area. Report accidents to the manager or owner and insist that they make a record of it.
You should know that in such a case, it is your responsibility to prove that a hazard existed and that it was the cause of your accident.
