    • The Ohio Supreme Court held that Ohio’s first Worker’s Compensation Subrogation statute was unconstitutional, and that an injured worker did not have to pay to his employer the medical expenses portion of his recovery from a third party tortfeasor.

    • The 8th District Court of Appeals held that a political subdivision was not immune from liability resulting from its negligent actions in the operation of a nursing home.

  • Holl v. Montrose, Inc. (1992), 82 Ohio App.3d 644.
    • The 9th District Court of Appeals held that a restaurant patron’s prior usage of a stairway without incident was not sufficient to charge her with knowledge of a defective condition of the stairway.

    • The 9th District Court of Appeals held that an expert witness may base his opinion on the hearsay statement of another expert where cost of treatment is involved.

  • Vahila v. Hall, 1997, 77 Ohio St.3d 42.
    • The Ohio Supreme Court made a new standard for legal malpractice in which a litigant was not required to prove that he would have been successful on an underlying cause of action. The Court held that the traditional concepts of negligence and proximate cause should apply in legal and professional malpractice cases.

  • Petras v. Ohio Concrete Constr. Co., 1995, 74 Ohio St.3d 186.
    • Amicus Brief for Ohio Academy of Trial Lawyers. The Ohio Supreme Court was urged to apply Ohio's statutory law to mandate that Ohio property owners provide a safe place to work for individuals working on their property, and to hold the party responsible for the control of the safety procedures at a construction site accountable for injuries suffered by workers as a result of unsafe conditions.
